Customer

Any person who uses the site and, where applicable, orders Sarab Festival Tickets and Complementary Services.

Ordering

The order of one or more Sarab Festival Tickets and, where applicable, Complementary Services.

The order is a contract which includes acceptance of these general terms and conditions of sale, the specific terms and conditions of the order and, where applicable, the general and specific terms and conditions of sale of the Partner providing the Complementary Services.

Sarab Festival

Electronic music festival held in the Agafay desert, near Marrakesh, Morocco, on 27 and 28 September 2024.

Tickets

Document validly issued by FVS granting access to the Sarab Festival.

Participant

Any Customer who has a Ticket allowing access to the Sarab Festival.

Organiser

FVS

Complementary Service

Services other than Tickets, such as parking and shuttle services.

Sarab Festival account

The My Sarab Festival account is a central feature designed to offer users a simplified experience when attending the Sarab Festival. This account allows users to easily access their tickets via a dedicated link. Users will also be kept up to date with practical news about the festival, such as programming updates, event times and essential information.

 

Sarab Festival bracelet

Bracelet containing an electronic chip, issued by the Organiser to the Participant on the Sarab Festival Site and onto which the Participant can load sums of money to be spent on the Festival Site. The Bracelet also serves as access to the Festival and to the various zones (VIP, for example).

Waiting list

List to which Customers who wish to be kept informed of the sale of Tickets, and of the possible resale of certain Tickets already sold, subscribe when the Tickets are sold out.

A Sarab Voucher is a document concerning the purchase of a Ticket and/or Complementary Service, issued by FVS or an independent third party, on the Festival Site, which entitles the holder to specific products or services, as the case may be, on or around the Festival Site.

 

Specific conditions may apply to the purchase of a Sarab Voucher issued for Services offered by a Partner.

 

 

 

 

 

 

PART I – GENERAL TERMS AND CONDITIONS OF USE OF THE WEBSITE

 

ARTICLE I.1 – PURPOSE – SCOPE OF APPLICATION

 

These general terms and conditions govern the relationship between the Customer and FVS. These general terms and conditions apply to access, use, consultation and all operations on the Site.     

By connecting to the Site, the Customer acknowledges that he/she has read these terms and conditions and accepts them.

These terms and conditions are accessible at all times on the Site, so that by accessing the Site or placing an Order, Customers confirm their acceptance of these terms and conditions.

 

ARTICLE I.2 – ACCESS TO THE SITE – MODIFICATIONS

 

Access to the Site’s home page and its content is free. Orders for Tickets and Services can be placed on the https://sarabfestival.com/ website.

 

FVS may, at any time, modify and adapt these Conditions without prior notice, in particular in order to:

 

  • correct certain errors, inaccuracies or inconsistencies;
  • to add new provisions to the text;
  • bring them into line with legislative or regulatory provisions ;
  • to bring them into line with any decision handed down by a court or arbitration tribunal, or issued by any other competent authority;

 

The applicable Conditions will be those in force at the time of the last use of the Site.

 

FVS will give notice of any modification and/or adaptation of the Terms, or any other rules relating to the use of the Site, before such modification or adaptation comes into effect.

 

ARTICLE I.3 – GENERAL INFORMATION

 

The Site is accessible without guarantee of any kind. Customers use the Site and linked sites under their own and sole responsibility. Despite all the care taken in the construction of the Site, FVS does not guarantee in particular:

  • the absence of errors in the functionalities offered by the Site;
  • no interruption in the operation of the Site;
  • immediate correction of any defects;
  • the absence of viruses or any other harmful element;
  • there are no errors in the information provided on the Site.

 

 

 

 

FVS accepts no liability for any damage caused by, inter alia, interruption, defect, delay in operation or transmission, computer virus or similar technical problems, network failure, or for any other reason whatsoever, in connection with the use of the Site or its content. FVS is not responsible for the content of third-party sites, even if the Site refers to them by means of a hyperlink.

FVS manages the content of the Site freely and independently. It may therefore, in particular, without prior notice :

  • suspend or cancel access to the Site or any part of it;
  • modify the information and products available on the Site;
  • modify the presentation of the Site, its structure and its sections.

 

FVS makes no guarantee or contractual commitment with regard to the images, multimedia, videos, photographs, etc. published on the Site to promote the first edition of the Sarab Festival. The Customer acknowledges and accepts that the Festival Site, stages, sets, locations, infrastructures, etc. may differ from the images represented on the Site.

 

ARTICLE I.4 – INTELLECTUAL PROPERTY RIGHTS

 

The entire content of the Site, including in particular the visuals, graphics, logos, buttons, images, video, HTML code, database, text content and icons is the intellectual property of FVS, or of content for which FVS has been granted the rights of exploitation. Some of the names, distinctive signs and logos appearing on the Site are registered trademarks or trade names belonging to FVS or third parties.

 

Any copy, translation, adaptation, modification or use whatsoever of all or any of the protected elements of the Site, in any form whatsoever and by any means whatsoever, is strictly prohibited without the prior written consent of FVS.

Customers undertake to respect these intellectual property rights and not to copy, reproduce, extract, exploit or alter, in any form whatsoever and by any process whatsoever, the information contained on the Site, including these Conditions.

 

 

 

PART II – GENERAL TERMS AND CONDITIONS FOR THE SALE OF SARAB FESTIVAL TICKETS

 

ARTICLE II.1 – PURPOSE – SCOPE OF APPLICATION

 

These general terms and conditions of sale of Tickets sold by FVS to Customers via the Site or via partners linked to the Sarab Festival apply to all contracts concluded between FVS and Customers, whether directly via the Site or via one of its partners.

 

The Customer expressly acknowledges having read and accepted these General Terms and Conditions of Sale before finalising their purchases.

 

Tickets are sold by Paylogic.nl. for tickets in Euros and Billeterie.ma for tickets in MAD (Moroccan dirham).

 

These General Terms and Conditions of Sale form an integral part of the Contract resulting from the purchase of one or more Ticket(s) or Services in connection with the Sarab Festival.

 

ARTICLE II.2 – REGISTRATION

 

The Customer can place an Order on the Website: https://sarabfestival.com/ via the integrated ticketing service provided by partner Paylogic.nl. and billeterie.ma

 

Before confirming the creation of a Sarab Festival Account and/or an Order, the Customer confirms that he/she has read and accepted the General Terms and Conditions of Sale.

 

In the case of purchases made on behalf of third parties for whom it is presumed to be the agent, it is the responsibility of the Customer to inform these third parties of these Terms and Conditions and of any other terms and conditions that may apply to this Contract, and to obtain their acceptance of these Terms and Conditions at the latest when the Contract is concluded.

 

FVS may, at any time, modify and adapt these General Terms and Conditions of Sale in order to:

 

  • correct certain errors, inaccuracies or inconsistencies;
  • to add new provisions to the text;
  • bring them into line with legislative or regulatory provisions;
  • to bring them into line with any decision handed down by a court or arbitration tribunal, or issued by any other competent authority;

 

Without prejudice to the following, the applicable Conditions are those in force at the time of the Order.

 

FVS will notify any modification and/or adaptation of the Conditions, or any other rule relating to the use of the Site, before the modification or adaptation in question comes into force. This notification will be made by e-mail. Unless the Customer notifies legal@sarabfestival.com that it does not accept the new version of the Conditions, the new conditions will apply within 5 days of notification of the changes.

 

 

 

 

 

 

 

ARTICLE II.3- ORDERING TICKETS AND SERVICES

 

  1. Ordering procedure

 

To order Tickets and Services sold by FVS on the Site, the Customer must select them and place them in his shopping basket. A Customer may order a maximum of 20 Tickets.

 

Complementary Services are reserved for Customers ordering Tickets.

 

Tickets are nominative.

 

Placing an Order implies acceptance of these General Terms and Conditions of Sale. The Customer undertakes to ensure that any third parties designated in the Order as Ticket holders accept these General Terms and Conditions.

 

FVS nevertheless reserves the right to cancel the Order for technical reasons, in particular if the sales quotas for certain categories are exceeded. In this case, the Customer will be immediately reimbursed for the amount of the Order, and may not claim any additional compensation.

 

  1. Prices and payment

 

Prices are expressed in euros, including VAT, on the Paylogic.nl ticketing service and prices are expressed in mad (Moroccan dirham) on the billeterie.ma ticketing service.

 

If FVS detects an error in the price of the Ticket or Service(s) ordered, it will inform the Customer as soon as possible and will either offer to confirm the order at the correct price or to cancel it.

 

If FVS does not receive a response from the Customer on the alternative proposed within five calendar days, it will cancel the order and refund the amount paid by the Customer.

 

The payment methods offered on the Site are, in particular, the following: Bancontact, mister cash, apple pay, bank card, ING Home’bank, Maestro, Ideal, Mastercard, Paypal, Sofortuberweisung and visa (non-exhaustive list, depending on the ticketing service chosen).

 

Tickets are available subject to prior payment.

In the event of payment in instalments, tickets will also be issued subject to prior payment of the full amount of the order.  

 

  1. Encoding information when ordering

 

For each Ticket ordered, the Customer must enter his/her surname, first name, email address, date of birth, postcode and country of residence. Customers who order Tickets for third parties confirm that they have obtained authorisation to enter the personal data of third parties as part of the order.

 

 

 

 

The Customer must enter identification details that are correct, complete and valid for any Order placed on the Site.

 

Otherwise, access to the Festival and the various Complementary Services may be refused by FVS or by one of its service providers.

 

If the details of the persons to whom the Tickets are allocated are not completed at the time of the Order, they must be completed by the date indicated in the Order confirmation email. At the very least, a reminder email will be sent to the customer. The penalty incurred will be cancellation of the order or refusal of access to the festival website and the services of its partners.

 

  1. Age limit

 

Participants must have been born no later than 2006 to be eligible for access to the Festival. Access may be conditional upon presentation of an original, valid and official identity document showing the Participant’s date of birth.

 

No exception will be made to this rule, even if the person is accompanied by a parent, guardian and/or other adult. No reimbursement will be made if the Participant is unable to attend the Festival due to non-compliance with the age limit.

 

  1. Receipt of the Order

 

Once payment has been made, Customers will receive confirmation of their purchase by email, detailing the Services purchased. Customers will receive their electronic Tickets by email no later than two weeks before the Festival, at the email address they provided when placing their Order.

 

The Sarab Festival Bracelet will be given to each Participant at the entrance to the Festival, on presentation of the electronic Ticket only.

 

The purchase confirmation e-mail does not give access to the Festival.

 

  1. No right of withdrawal

 

In accordance with article VI.53, 12°, Code of Economic Law, the Customer does not have a right of withdrawal of 14 days from the date of conclusion of the Contract.

 

The Order shall be binding on the Customer subject to the possibilities of exchange or resale set out in these Terms and Conditions.

 

ARTICLE II.4 – TICKETS

 

Unless otherwise stipulated, Tickets are non-refundable.

 

Similarly, the theft or loss of tickets does not entitle the holder to a refund or replacement.

 

If your wristband is lost or stolen during the event, Sarab is not obliged to issue you with a new one, nor can a refund be requested.

 

The Customer’s attention is drawn to the provisions of the law of 30 July 2013 on the resale of tickets for access to events, which prohibits the resale of tickets on a regular basis, the resale of tickets on an occasional basis at a price higher than the initial purchase price, and the sale of privileged or promotional tickets that have not been the subject of an initial sale.

 

Any counterfeit ticket will result in refusal of access to the Festival and may give rise to legal proceedings.

 

Tickets may be exchanged only on request and after acceptance by FVS, in particular to upgrade the Services concerned. Where applicable, transaction fees depending on the means of payment used and service charges may be charged to the Customer at the time of exchange.

 

Tickets may also be resold via a resale platform made available via the Site, subject to acceptance of the specific conditions of use of this platform. The Customer will receive the sale price of his/her Ticket(s) once the new purchaser(s) have paid the price. Where applicable, the Customer may be charged a transaction fee depending on the payment method used and a service fee at the time of exchange.

 

ARTICLE II.5 – FESTIVAL RULES OF PROCEDURE

 

Ordering tickets implies acceptance of the Festival’s Internal Regulations:

 

  1. Access and programming

 

The Festival runs from 27 September 2024 to 28 September 2024.

 

Festival opening hours and access times to the Festival site will be announced on the Site.

 

Access to the Festival is reserved for Participants holding a Ticket. Only Tickets sold by FVS and its official partners will be considered valid. FVS reserves the right to refuse access to the Festival and Complementary Services to any person who is not in possession of a valid Ticket.

 

All Participants must have left the premises (Festival site and car parks) by 06:00 on 28 September 2024 at the latest.

 

The times of the concerts scheduled during the Festival are given for information only. FVS is entitled, for reasons beyond its control, (for example, weather conditions, security reasons, compelling circumstances, cancellation or delay of scheduled artists, events compromising security, etc.) to adapt and/or modify the Festival programme without these adaptations and/or changes being considered as a circumstance giving the Participant the right to a total or partial refund of the Ticket(s).

 

The Participant acknowledges and accepts that the Services relate to the Festival in general, considered as a whole, and not to one or more artist performance(s) considered individually.

 

  1. Access – Exit

 

Any person wishing to enter the Festival Site agrees to submit to an identity and security check, carried out in application of the legal and regulatory provisions in force in Morocco, and which may involve the searching and palpation of persons and bags.

 

Customers may not enter or leave the site at will. For security reasons, once you have left Sarab Festival, you are not allowed to return the same day, even if you have a 2-day wristband.

 

FVS reserves the right to refuse entry to Festival Visitors arriving on Saturday or Sunday after 21:00 on the Festival Site, even if the customer is in possession of a valid entry ticket or wristband.

 

Any person found to be in possession of prohibited and/or dangerous substances and/or objects may be refused access to the Festival or expelled without being entitled to a refund or exchange of their ticket.

 

A refusal of admission in accordance with these Conditions does not entitle the applicant to

a refund.

 

The same shall apply to any person who, by way of example :

 

  • is under the influence of narcotics and/or illegal substances, or is drunk;
  • is in possession of narcotic and/or illegal substances, which may be confiscated by security personnel;
  • adopts behaviour and/or dress and/or distinctive signs likely to incite violence, hatred, racism, xenophobia, etc., and generally to disturb public order and/or the peace;
  • is in possession of prohibited items, which may be confiscated by security staff;
  • refuses to undergo security checks;
  • harms the physical integrity of other persons present on site or could represent a threat in this respect;
  • does not comply with the Conditions and, in particular, the internal rules.

 

All persons present on the Festival Site agree to submit, at all times, to the instructions of FVS, its representatives and/or agents and security personnel so that, throughout the Festival, safety, the well-being of festival-goers and public order are maintained in an optimal manner.

 

Each Participant accepts that, as a result, the Festival may be interrupted or cancelled, and that persons present on the Festival Site may be prohibited from entering or leaving it or ordered to remain there until further notice.

 

  1. Prohibited items

 

The following items in particular are prohibited:

 

  • narcotics of any kind;
  • liquid, gaseous and pasty substances in containers of more than 100ml and generally any flammable product (medicines may be kept on presentation of a prescription or medical certificate no more than 15 days old);
  • sharp, cutting, blunt or pointed objects, and any weapon or object that could constitute a weapon of any kind;
  • Drones;
  • animals, with the exception of guide dogs;
  • food and drink not originating from the Festival Site;
  • banners ;
  • any other object considered by security personnel to present a security risk or whose contents cannot be identified.

 

 

  1. Prohibited behaviour

 

The following behaviours in particular are prohibited:

 

  • enter areas where access is forbidden to the public;
  • obstruct the entrance and exit areas and emergency exits of the Festival;
  • climb on fences, stages, and in general on all structures on the Festival site;
  • sell food, drink or any other product without the prior written consent of FVS ;
  • urinating in public or behaving in any other way that is morally or socially inappropriate;
  • conceal all or part of their face so that they are no longer recognisable;
  • throw any projectile ;
  • make a fire ;
  • stage-diving;
  • engage in any criminal behaviour;
  • behave in a disrespectful manner or in such a way as to disturb the well-being of other participants;
  • canvass or promote any product or service without the prior written authorisation of FVS.

 

ARTICLE II.6- CASHLESS PAYMENTS AT THE FESTIVAL

 

  1. General

 

The Festival is cashless, which means that no cash payments are permitted on the Festival Site. This cashless payment system is used with the Sarab Festival Bracelet.

 

However, FVS reserves the right to set up alternative card payment systems at its sole discretion. FVS cannot be held responsible in the event of failure of the Sarab Festival Bracelet payment system. In this case, FVS will do its utmost to propose an alternative payment system.

 

FVS will not be able to provide any invoices or details of payments made by the Bracelet Sarab Festival.

 

The payment system is operated by third-party service providers.

 

Participants acknowledge and accept that they bear the risk of loss or theft of their Sarab Festival Bracelet. It is the responsibility of Participants to report loss or theft immediately and to have their Sarab Festival Bracelet deactivated at the (re)loading point inside the Festival site or at the accreditation point outside the Festival site.  The amount remaining on the bracelet at the time of deactivation will be transferred to the replacement bracelet. FVS reserves the right to charge for the replacement wristband and service fees.

 

  1. Refills

 

Participants top up the Sarab Festival Bracelet with the amount of their choice. Top-ups are made in Moroccan dirham.

 

Recharging can be done either at https://sarabfestival.com/ before the event or during the event at the charging points available on the Festival Site, in return for payment by credit card.

 

 

  1. Claims

 

Participants are required to immediately report any dispute relating to a transaction linked to the cashless payment system via the following address: cashless@sarabfestival.com, enclosing any supporting documents required to investigate the claim.

 

Dedicated contact points are also available on the Festival site for Participants throughout the Festival.

 

FVS reserves the right to reject complaints if no evidence or documentation relating to the problem and/or dispute has been submitted. Participants can track top-up transactions via their Partner account. As there may be a delay in processing top-up transactions carried out during the Festival (offline), there may also be a delay in updating information on the Partner Account.

 

 

  1. Refunds

 

A refund of the money loaded onto the electronic bracelet may be requested within 15 days at the latest from the end of the Festival and only for amounts of €5 or more. FVS reserves the right to charge an administrative processing fee for the refund, which will be specified on the site when the Sarab Festival Bracelets top-up is available.

 

Requests for reimbursement should be sent to the following address: cashless@sarabfestival.com, giving all the details required for identification, such as surname, first name and order number.

 

Refunds will be made automatically when the payment method used by the Participant to recharge his/her Sarab Festival Bracelet is operated by Bancontact, iDeal, Visa or Mastercard. FVS reserves the right to add or remove payment systems from the list.

 

Automatic refunds will generally be made within 15 days of the end of the Festival. This timing is purely indicative and depends on the payment system operator, the currency used for payment, the country in which the payment method was issued, etc.

 

 

 

ARTICLE II.7 – PARKING

 

The Customer may, when ordering tickets or independently of the order, reserve a ticket giving access to a parking space in the car parks dedicated to the Festival.

 

This access ticket does not give access to a specific parking space.

 

 

ARTICLE II.8 – LIABILITY

 

FVS cannot be held liable, except in the case of fraud, gross negligence (including that of its employees or agents) or – except in the case of force majeure – non-performance of an obligation consisting of one of the main services in the contract.

 

In the event that FVS is held liable, notwithstanding the aforementioned assumptions of limitation and exoneration of liability, it will then be limited to direct damages (excluding indirect damages), and in any event, to the amount of the price of the Ticket and the Services sold to the Customer concerned.

 

The Customer’s attention is drawn to the fact that FVS cannot incur any liability for any damage, theft, deterioration or accidents occurring in the car parks, on the transport and in the accommodation made available to Customers. The Customer therefore accepts that the use of these car parks, accommodation and transport is carried out under his/her own responsibility and at his/her own risk.

 

Changes to the Festival programme do not constitute grounds for FVS to incur liability and do not entitle the Customer to any reimbursement or to cancel the contract.

 

 

 

 

 

 

 

ARTICLE II.9 – FORCE MAJEURE

 

FVS will not be liable for non-performance or delay in performance of any of its obligations when such non-performance is due to a case of force majeure within the meaning of article 5.226 of the French Civil Code.

 

For the application of this article, the following circumstances, in particular, are considered to be cases of force majeure and constitute grounds for suspending or terminating FVS’s obligations (without this list being exhaustive), which render the performance of these obligations (with the exception of payment obligations) impossible, dangerous, impracticable or unreasonable: fire, natural disaster, exceptional climatic and/or meteorological events, adverse weather conditions (or risk of the occurrence of weather conditions) considered by the competent authorities to constitute a threat to the safety of persons and/or property, national or international emergency, strike, act of hostility towards the State, act of terrorism or threat of terrorism, riot or civil commotion, accident, interruption or significant delay or failure of technical installations, failure or significant delay of the necessary transport services, exceptional difficulties and impossibilities of using the means and channels of transport, order or command of the public authorities, changes in regulations, epidemic, pandemic, breakdown of machinery, (threat of) war, act of a third party or any external event of such a nature as to delay or prevent the performance of the obligations concerned…

 

In the event of force majeure, the obligations of SRL FVS will be suspended for the duration of the force majeure and its performance deadlines will, where applicable, be extended by a period equivalent to the duration of the force majeure, if such an extension is materially possible.

 

If the case of force majeure results in it being definitively impossible for FVS to perform its obligations, the latter will be released from them. FVS will notify the Customer by any means it deems useful (notice on the Festival site, e-mail, notice on the website, notice in the press, on social networks, etc.).

 

Where applicable, the Customer will be entitled, in accordance with the applicable legal provisions, to a refund of all or part of the ticket purchased, depending on whether force majeure results in the cancellation of all or part of the Festival. In this case, only tickets for the Festival sensu stricto will give rise to total or partial reimbursement, to the exclusion of Complementary Services.

 

ARTICLE II.10 – COMMUNICATIONS

 

Unless otherwise specifically provided for in these Terms and Conditions, any communication to be sent to the Customer shall be deemed to have been properly sent if it is sent to the e-mail or postal address indicated by the Customer when placing the Order.

 

ARTICLE II.11 – IMAGE RIGHTS – PHOTOS AND VIDEOS

 

Participants acknowledge and accept that they may be filmed during the Festival, and that the images may be processed, used and communicated to the public by FVS and any of its partners, even if they are directly recognisable.

 

In the absence of prior written authorisation from FVS, photos or videos taken by the Participant during the Festival, on the Festival Site, may not be distributed for commercial purposes without the express, prior and written agreement of FVS.

 

The Festival is also monitored by cameras in accordance with the applicable legal provisions. This camera surveillance is carried out for security purposes and the recordings made will only be transmitted to the competent authorities in compliance with the applicable legal provisions.

 

ARTICLE II.12 – MISCELLANEOUS PROVISIONS

 

  1. Waivers

 

No waiver by SRL FVS of any of its rights may be inferred other than from an express, certain and written expression to that effect.

 

  1. Nullity

 

The invalidity of any of the clauses of these Conditions shall be limited to the invalid clause and shall not affect the remainder of these Conditions.

 

  1. Applicable law

 

Belgian law is applicable, to the exclusion of the rules of private international law.

 

 

  1. Settlement of disputes

FVS may only be sued before the competent courts of its registered office (Charleroi, Hainaut, Belgium).

 

FVS may nevertheless, at its discretion, summon the Participants or Customers before the courts of the place of its registered office (Charleroi, Belgium) or before the courts of Marrakesh (Morocco).

 

 

 

 

PART III – GENERAL TERMS AND CONDITIONS OF SALE FOR THE TRAVEL PACKAGE

 

The terms and conditions are available on the web page of our travel partner, who sells travel packages on their website.

When you purchase products and/or services through our partners S’tours or Mind&motion, it is the partner who is your contracting party.
